Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the Arthya mobile application or by visiting our website at https://shreerajdeepfinance.co (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, please do not use the Service.

These Terms form a binding contract between you ("User", "you", "your") and Arthya, operated by [Operating Entity Name — to be inserted before publish], with registered office at [Address — to be inserted before publish] ("Arthya", "we", "us", "our").

2. Nature of Service — Important Disclosure

Arthya is not a lender. Arthya is a digital intermediary / loan marketplace that helps you discover and submit inquiries to RBI-registered Non-Banking Financial Companies (NBFCs) and banks ("Lender Partners"). We do not:

  • Issue any loan to you
  • Approve, reject, or underwrite any loan application
  • Disburse loan funds
  • Collect loan repayments
  • Hold a banking license, NBFC license, or any regulated lending license

All loan-related decisions, including eligibility, approval, interest rate, tenure, sanction amount, processing fee, prepayment terms, repayment schedule, and any related conditions, are made solely by the Lender Partner you choose to apply with. Arthya does not control, guarantee, or influence these decisions.

3. Eligibility

You must:

  • Be at least 18 years of age
  • Be a citizen or resident of India with a valid Indian mobile number
  • Have the legal capacity to enter into a binding contract under the Indian Contract Act, 1872
  • Provide truthful and accurate information

Use of the Service by anyone under 18 is strictly prohibited.

4. Account Registration

To use the Service, you must register using your Indian mobile number, which is verified through Firebase Phone Authentication. You are responsible for:

  • Keeping your account credentials secure
  • Notifying us immediately of any unauthorized access
  • All activity that occurs under your account

We reserve the right to suspend or terminate accounts that are misused, used fraudulently, or used in violation of these Terms or applicable law.

5. User Conduct

You agree not to:

  • Provide false, misleading, or fraudulent information when submitting any inquiry or application
  • Use the Service to impersonate another person or entity
  • Use the Service for any illegal purpose or in violation of any applicable law
  • Attempt to gain unauthorized access to any part of the Service or any related systems
  • Use automated means (bots, scrapers) to access the Service without our prior written consent
  • Engage in any conduct that interferes with or disrupts the Service
  • Submit content that is defamatory, obscene, abusive, or that infringes any third-party rights
  • Resell or commercially redistribute access to the Service

Violations may result in immediate account termination and, where appropriate, legal action.

6. Loan Inquiries and Applications

When you submit a loan inquiry through the Service:

  • You authorize us to share the information you provided with the specific Lender Partner you selected
  • You acknowledge that the Lender Partner becomes a separate data controller for the information shared with them, and their use of your data is governed by their own privacy policy and terms
  • You understand that submission is not a guarantee of loan approval, and Arthya makes no representation about the outcome
  • You agree to deal directly with the Lender Partner for all matters related to your loan application after we have made the introduction

7. No Guarantee of Approval

We make no warranty, express or implied, that any loan inquiry submitted through the Service will result in a loan offer or approval. Approval is at the sole discretion of the Lender Partner, based on their internal credit policies, your credit history, income verification, and other factors.

We do not pull your credit report or credit score. Submitting an inquiry through Arthya will not, by itself, affect your credit score.

8. Fees

Arthya does not charge users any fee for using the Service. We may receive a commission or referral fee from Lender Partners when a loan is disbursed through our platform — this is paid by the lender and does not affect the loan terms you are offered.

Lender Partners may charge processing fees, prepayment penalties, late-payment charges, or other fees per their own loan terms. You are responsible for reviewing the Lender Partner's terms before accepting any loan offer.

9. Intellectual Property

All content, design, logos, source code, and other intellectual property on the Service belong to Arthya or our licensors. You are granted a limited, non-exclusive, non-transferable license to use the Service for personal, non-commercial purposes only. You may not copy, modify, reverse-engineer, distribute, or create derivative works without our prior written consent.

10. Third-Party Services

The Service relies on third-party providers including Google Firebase, MongoDB, Cloudflare R2, and our Lender Partners. We are not responsible for the availability or performance of these third-party services. Their terms and privacy policies apply independently.

11. Disclaimers and Limitation of Liability

To the maximum extent permitted by law:

  • The Service is provided "as is" and "as available" without any warranty of any kind, express or implied
  • We disclaim all implied warranties of merchantability, fitness for a particular purpose, and non-infringement
  • We do not warrant that the Service will be uninterrupted, error-free, or free from security vulnerabilities
  • In no event will Arthya, its directors, officers, employees, or affiliates be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or goodwill, arising out of or in connection with your use of the Service
  • Our total cumulative liability to you for any claim arising out of or relating to the Service or these Terms shall not exceed INR 1,000

Nothing in these Terms limits liability that cannot be limited under applicable Indian law (such as liability for fraud).

12. Indemnification

You agree to indemnify, defend, and hold harmless Arthya, its directors, officers, employees, and affiliates from any claim, demand, loss, or expense (including reasonable attorneys' fees) arising out of:

  • Your use or misuse of the Service
  • Your violation of these Terms
  • Your violation of any applicable law or third-party right
  • Information you submit to Lender Partners through the Service

13. Account Termination

You may delete your account at any time through the in-app "Delete account" option in Settings. Upon deletion:

  • Your personally identifiable information is anonymized immediately
  • Complete hard-deletion of the record occurs 30 days later (subject to legal hold)
  • You will be logged out of all sessions
  • Your loan applications already submitted to Lender Partners are not retracted from the lender (you must contact the lender directly to withdraw)

We reserve the right to suspend or terminate your account at any time for violation of these Terms, fraud, or other lawful reasons.

14. Modifications to the Service and Terms

We may modify, suspend, or discontinue the Service (or any part of it) at any time. We will provide reasonable notice of material changes where possible.

We may update these Terms from time to time. The "last updated" date at the top reflects the most recent revision. Continued use of the Service after changes constitutes acceptance of the revised Terms.

15. Grievance Officer

In accordance with the Information Technology Rules, 2021, we have appointed a Grievance Officer. You may contact the Grievance Officer for any complaints related to the Service:

We will acknowledge grievances within 24 hours and resolve them within 15 days, in accordance with applicable rules.

16. Governing Law and Jurisdiction

These Terms are governed by the laws of India. Any dispute arising out of or relating to these Terms or your use of the Service shall be subject to the exclusive jurisdiction of the courts in [City — to be inserted before publish], India.

Before initiating any litigation, you agree to attempt good-faith resolution by contacting our Grievance Officer.

17. Force Majeure

We are not liable for any delay or failure to perform caused by events beyond our reasonable control, including natural disasters, war, civil unrest, regulatory action, internet outages, or third-party service failures.

18. Severability

If any provision of these Terms is found unenforceable, the remaining provisions remain in full effect.

19. Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Arthya regarding the Service and supersede any prior agreements.
